Phil Spector trial: Day 23

The judge in the Phil Spector murder trial ruled today (June 14) that Sara Caplan, the producer's former lawyer, could be held in contempt of court if she refuses to testify about whether she saw a defence expert mishandle potential evidence.

Los Angeles County Superior Court Judge Larry Paul Fidler apparently felt remorse about his decision, but said he had no choice but to rule the way he did.

"I see no reason why Miss Caplan should not testify. There is no other person who can testify to what she saw," he said.

Fidler said it was the first time in his 25 years on the bench that he had to threaten an attorney with contempt.

"I admire her for taking the stance she is taking; I don't agree with it," he said, adding "nobody has any personal animus against Miss Caplan."

Caplan was on the defence team that searched Spector's Los Angeles mansion the day after actress Lana Clarkson was found shot in the mouth on February 3, 2003.

In an evidentiary hearing, Caplan testified that she saw forensic scientist, Henry Lee, pick up small white object that may have been one of Clarkson's acrylic fingernails.

The prosecution maintains that this information could support their case. However, Caplan has refused to take the stand in open court because it may violate attorney-client privilege.

Caplan could face criminal penalties as a result of the ruling, but she has until June 22 to appeal the decision to a higher court, reports the Los Angeles Times.

Spector is accused of murdering Clarkson, but the defence contends she shot herself.
Avril's Agenda: New Video, Shows, Film Work

Avril Lavigne says she's "just excited to have the record out and for everyone to hear it." But notching two weeks at No. 1 makes her pretty excited, too.

"It's a really exciting time for me," Lavigne told Billboard.com in the midst of her current promotional swing through Japan, Hong Kong and Australia to promote her third album, "The Best Damn Thing." "It felt really good."

But, she added, "People are like, 'Did you feel pressure?' and it's like, no. I never have, which is really good. I don't really think about things; I just do them. Of course I was like, 'Well, OK, how'd (the album) do?' But it wasn't like I was freaking out. I'm pretty chill."

Then again, "The Best Damn Thing" shows no signs of cooling off. With the first single, "Girlfriend," already having topped the Billboard Hot 100, the album is No. 1 on The Billboard 200 for the second consecutive week. So far it's sold more than 1.75 million copies around the world, according to RCA.

When she returns, Lavigne will film a video for the album's second single, the ballad "When You're Gone," and begin rehearsals for festival dates she's playing this summer. A full-scale tour isn't planned until 2008, but we'll still be seeing plenty of Lavigne in the coming months.

After logging roles in "Fast Food Nation" and the animated feature "Over the Hedge," Lavigne joined Richard Gere and Claire Danes in the police thriller "The Flock," the English language debut by Hong Kong action director Andrew Lau that's currently in limbo while being re-cut by another director.

Later this year she'll film a starring role in "Twist of Fate," which she called "a dark kind of drama, sort of indie, kind of, but not too indie" that lets her do "a lot of freaking out and crying."

"I've been reading scripts for a really long time, and I haven't liked anything," Lavigne says. "I found something that was really awesome, something that I liked, and I'm gonna be the lead and work on it this winter."

"Twist of Fate" is expected to open in late 2008.
